General terms and conditions of sale

It is hereby specified that these terms and conditions govern exclusively sales by the limited liability company " Kcosmetique " on the website www.fournisseurgrossistepascheryeslove.com of cosmetic products (hereinafter referred to as the site).

Kcosmetique Company specializes in cheap makeup, also known as "discount makeup".

This low-cost cosmetics wholesaler will allow you to grow with new brands as a French distributor for them.

These products are sold new to customers for their professional use.

Article 1 - Acceptance of the general terms and conditions of sale

The customer declares having read and accepted these terms and conditions of sale before placing their order. Therefore, validation constitutes acceptance of our terms and conditions of sale.

Article 2 - Order

The customer is solely responsible for completing the online order form, specifying the product references and quantities. The customer must also provide their name (or customer number if applicable) and delivery address. Kcosmetique cannot be held liable for any resulting errors made by the customer, including delays or delivery failures. Any additional costs for reshipping the package will be borne by the customer.

The customer must check the details of their order before shipment. All orders placed and paid for cannot be cancelled.

All orders will be final only after debiting the customer's bank account in the case of payment by card on the site or after cashing the check in the case of payment by bank check.

Kcosmetique reserves the right to refuse an order if there is an ongoing payment dispute with the customer or if the customer has not paid for a pending order.

The contractual information will be confirmed in writing no later than the time of delivery of the product.

Article 3 - Products

The customer is informed that there may be differences between the product photos on the website and the products themselves (size, color, packaging, etc.).

Article 4 - Product availability

Product and price offers are valid as long as they are visible on the website and while stocks last. In the event a product becomes unavailable after an order has been placed, the customer will be notified by email. KCosmetique may then offer the customer a similar product at the same price. The customer reserves the right to refuse this offer and cancel their order; in this case, they must send an email to the following address: contact@kcosmetique.fr. If a check has already been sent to KCosmetique, the company undertakes to return it within a maximum of one week. If the customer's bank account has already been debited, the customer will be refunded within a maximum of 30 days. The customer may also receive a credit note valid for future orders, which will automatically expire after one year. After this period, the credit note will be permanently forfeited.

Article 5 - Product Price

The prices of our products are all indicated in euros, excluding taxes and excluding participation in processing and shipping costs.

The customer is informed of all these additional costs when placing their order on the website.

KCosmetique reserves the right to modify its prices at any time, but the product will be billed to the customer based on the price in effect at the time the order is validated. However, the product remains the property of KCosmetique SARL until full payment is received and the company receives payment.

Article 6 - Delivery/Delays

Products purchased on the website can be delivered within France. For deliveries to Corsica, an additional shipping charge will be added to the invoice.

For deliveries within Europe (Belgium, Spain, etc.), a special shipping fee will be charged.

Kcosmetique reserves the right to choose the most suitable mode of transport depending on the nature of the product, its weight and its volume.

If an order cannot be delivered due to incomplete or incorrect address information (intercom name, wrong phone number, no building access code), it will be returned to our warehouse after 6 days. Additional shipping charges will be applied to reschedule the order for pickup and a second delivery.

Orders weighing 30 kg or less:

Fast delivery by EXAPACK; the average delivery time is 2 to 3 business days from payment confirmation. These are average delivery times for the services used. Delivery times will not exceed 15 days after the customer's payment has been validated (for payments by check, the sooner the check arrives, the sooner the product will be delivered). The product will be considered delivered upon the first delivery attempt to the address provided by the customer when placing their order. If the customer is absent, they will be responsible for collecting the product from the relevant service provider, or a second delivery attempt will be made.

Orders weighing over 30 kg:

Fast delivery by Exapack: the average delivery time is 24 to 48 business hours from payment confirmation for all orders placed before 2 PM. Delivery will not exceed 15 days after payment confirmation, as stated above: "For payments by check, the sooner the check arrives, the sooner the product will be delivered." The product will be considered delivered upon the first delivery attempt to the address provided by the customer when placing their order. In case of absence, a second delivery attempt by SIC Express will be charged at €20 excluding VAT.

DPD DOES NOT DELIVERY ON WEEKENDS

If KCosmetique SARL cannot meet the delivery deadlines specified above, which vary depending on the order weight, the customer will be offered a new delivery date by email. However, if a delay of more than 7 days occurs after the delivery deadlines indicated above, the customer will have the option to cancel their order within 60 business days by registered letter with acknowledgment of receipt, in accordance with legal provisions. In this case, KCosmetique will issue a refund within 30 days of receiving the letter.


Article 7 - Order verification and transport disputes:

The customer must check the delivery immediately upon receipt, in the presence of the delivery driver. In case of damage, the customer may refuse the product or accept it with reservations. The customer must then report the damage to the driver. The customer must also send an email to KCosmetique to report the damage. If the damage is found to be due to the delivery, KCosmetique will initiate a claim with DPD, and the customer will receive a credit note corresponding to the lost products. If the damage is not acknowledged in the presence of the carrier, KCosmetique will not be held liable.

All disputes due to transport will only be compensated upon receipt of a credit note.

Article 8 - Payment:

Payment on the site can be made either:

You can pay by Visa or MasterCard directly on the website by filling out the order form following the instructions and then paying through the secure transaction site. Your card will be debited as soon as you receive the order confirmation.

Either by bank check, made payable to KCosmetique SARL and sent to KCosmetique SARL, 17-19 boulevard de la Muette, 95140 Garges les Gonesse.

Orders from abroad cannot be paid by bank check. The check will be cashed upon receipt.

Kcosmetique reserves the right to cancel an order for any reason. If the order is cancelled by Kcosmetique, a refund will be automatically issued upon receipt of bank details (RIB).

Article 9 - Right of withdrawal

In accordance with applicable legal provisions, the customer has a period of 7 days from the delivery of the product to exercise their right of withdrawal with KCosmetique SARL without having to justify reasons or pay penalties. In the event of exercising the right of withdrawal within the aforementioned period, only the price of the product(s) purchased and the shipping costs will be refunded to the customer; the return shipping costs will remain at the customer's expense.

The customer must inform KCosmetique by email at contact@kcosmetique.fr of their decision to exercise their right of withdrawal. KCosmetique will inform the customer by email or telephone of the return shipping or collection arrangements. Bulky products (over 30 kg) will be collected by a carrier chosen by KCosmetique from the customer's address indicated on the order form. The customer will be informed in advance of the return shipping cost. This cost will be deducted from the refund issued to the customer under their right of withdrawal. The customer has the right to request any justification from KCosmetique regarding the return shipping cost.

The product must be returned or collected by Kcosmetique in its original and complete condition (packaging, accessories, instructions, etc.) allowing its resale as new and accompanied by a copy of the purchase invoice.

Damaged or opened products will not be accepted for return.

Once the returned product has been deemed acceptable by KCosmetique, the company will reimburse the customer by check or credit card within 30 days of receiving the returned product. The refund will be sent to the billing address indicated on the order form.

Article 10 - Security

The Site uses a security system that employs the SSL (Secure Socket Layer) protocol to encrypt customer banking information. Information regarding this security system is described in the "Legal Information" section of the Site. Any non-payment due to fraudulent use of a bank card will result in the order details being recorded in the payment incident file.

For all emails sent to KCosmetique's customer service or after-sales service, please use the email address associated with your customer account. This will allow for faster processing of your order.

Article 12 - Password Management

KCosmetique will provide the customer with a password to access their customer account. This password is personal and confidential. The customer is solely responsible for the use and confidentiality of this password. KCosmetique disclaims all liability in the event of fraudulent use of this password.

Article 13 - Responsibility

The products offered comply with current French legislation and applicable standards in France. KCosmetique cannot be held liable for the importation of a product purchased on the Site into a third country. It is the customer's responsibility to check with local authorities regarding the import or use of the product purchased on the Site and to comply with applicable regulations.

The customer is advised to refer to the description of each product for its precise characteristics. KCosmetique shall not be liable for any indirect damages arising from this agreement, including but not limited to loss of business, loss of profits, loss of opportunity, or loss of data and files, which may result from the purchase of a product on the Site.

Article 14 - Non-conformity of a product upon delivery

If the delivered product does not correspond to the ordered product or if the product arrives damaged upon delivery to the customer, KCosmetique undertakes to issue a credit note valid for future orders for 1 month (provided that the customer has noted the details of the damage on the delivery note with the driver), after which the credit note will be lost.

The customer must inform KCosmetique of any delivery refusal or non-conformity by sending an email to contact@kcosmetique.fr. This email must be sent to KCosmetique within 24 hours of delivery (or refusal of delivery) of the product. The customer must specify in this email the product concerned (reference number) as well as the reasons for the delivery refusal or complaint.

In addition to sending the email to KCosmetique, the customer must follow the procedure described in Article 7 above regarding filing a claim with the carrier (or relevant services). KCosmetique will inform the customer by email or telephone of the conditions for returning the non-conforming product. All product returns by the customer are subject to KCosmetique's prior approval. A return number will be assigned to the customer by KCosmetique.

The non-conforming product must be returned or collected by KCosmetique in the condition in which it was received, in its original packaging with all included components and accessories (instructions, various accessories, etc.). KCosmetique will only be able to process a refund or replacement for the non-conforming or damaged product once it has been returned to KCosmetique.

The return costs that the customer may incur for the return of a non-conforming product will be reimbursed to the customer by KCosmetique upon presentation of supporting documents.

Any other product defects will be covered by the commercial warranty and/or the legal warranty, as specified in Articles 17, 18 and 19 below.

Article 17 - Legal guarantee against hidden defects

Article 1641 of the Civil Code: the seller is bound by the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which diminish this use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.

Article 1648 paragraph 1 of the Civil Code: the action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.

Article 20 - Applicable Law - Disputes

This contract is governed by French law. In the event of a dispute with professionals and/or merchants, the courts of Paris shall have exclusive jurisdiction, including in summary proceedings and third-party claims, and notwithstanding the plurality of defendants.

Article 21:

All photos on the Kcosmetique website are the exclusive property of the company. Any unauthorized use of these photos will require your permission; failure to obtain it may result in serious legal action.

Security and confidentiality

Data may be transmitted to third-party companies responsible for order tracking and/or payment processing. This data is also retained for security purposes, to comply with legal and regulatory obligations, and to allow Kcosmetique to improve and personalize the services offered to the customer.

In accordance with the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify, and object to the processing of their personal data. To exercise this right, the customer must write to Kcosmetique Customer Service, 17-19 boulevard de la Muette, 95140 Garges-lès-Gonesse, France, indicating their full name, email address, and, if possible, their customer reference number.

Customer data is neither sold nor rented to third parties. However, it may be used to send the customer information about products similar to those previously purchased. The customer may opt out of receiving these communications free of charge by writing to Kcosmetique, Orders Department, 17-19 boulevard de la Muette, 95140 Garges-lès-Gonesse, France.

All our cosmetic products are "Cruetly Free", although it has been totally forbidden for years in Europe to test any products whatsoever on animals.

Combating online payment fraud and requesting supporting documents

To prevent fraud, Kcosmetique may request all necessary supporting documents from the customer to process the order (proof of identity, proof of address, etc.). These requests will be made by email or telephone. Refusal by the customer to provide these documents will result in the cancellation of the order. The time required to send the requested documents to Kcosmetique may delay the delivery of the ordered product.
